The court voted unanimously Thursday to uphold the Colorado Division of Parks approval of the project.
In its ruling, the court noted the division did not follow its permit regulations in granting approval. But the ruling states the group that filed the suit, Rags Over the Arkansas River, failed to show prejudice that resulted from how the project was approved.
ROAR plans to file another legal challenge in the US Court of Appeals by Feb. 23.
"This is still a long way from being done," ROAR Spokesperson Joan Anzelmo told CPR via email. "ROAR intends to stop the OTR project!"
